"auDA, Board and Afilias proudly welcome the new auDA voting members.

auDA Management and Board strongly denies any stacking has occurred and looks forward to the engagement of these under represented stakeholders of the .au domain namespace.

At this stage none of the members use the .au namespace, nor do they actually own any .au domain names themselves.

auDA is happy to not verify any of the memberships under the circumstances as we know who had them join and how they will vote at the AGM.

We thank the auDA Director for his support of auDA's current Management and for the payment of these memberships himself.

We note there are no age restrictions, no country restrictions and no requirements members are actually human under the auDA Constitution so under our very expensive legal advise and personal opinions we maintain all of them are valid and able to vote ( also via proxy) at the AGM.

We ensure him we will look forward to his associated votes of his family members for our mutual benefit and interests and his sign ups will play an important part of our plans and vote count at the AGM."

auDA policy seemed to change to selective non contacting recently with the mass 900 Supply staff signed up into demand class when they wanted to try and set up to stack the AGM votes in their favour and meet the cut off dates. Over 500 foreign staff of Supply parties signed uo into demand class voting members?

The most blatant stacking of any corporate or Not For Profit organisation in the history of Australia or any namespace management membership ever globally!

auDA current Management and Board are "Not Fit For Purpose"
They need to be replaced to save auDA.

Very odd that they wouldn't just answer the question. Does he not have the qualifications or are they playing political games by letting rumours build? Gut feeling is the latter.

Gaslighting.

People who gaslight typically use the following techniques:

1. They tell blatant lies.
2. They deny they ever said something, even though you have proof.
3. They use what is near and dear to you as ammunition.
4. Their actions do not match their words.
5. They throw in positive reinforcement to confuse you.
6. They undermine the target [victim] by gradually weakening them and their thought process

In my opinion, the definition “Australian Internet Community” within the auDA Constitution is very relevant to the Boards decision about who is eligible as a member. Albeit clause 9 doesn’t specify the criteria for membership sovereignty, it’s absence should not detract from the whole document, which is given the meaning of, inclusive of all Australians.

PREAMBLE
Taking the view that the Internet Domain Name System is a public asset, and that the .au ccTLD is under the sovereign control of the Commonwealth of Australia, auDA will administer the .au ccTLD for the benefit of the Australian community.

auDA will administer the .au ccTLD for the benefit of the Australian community. auDA is composed of Supply and Demand Class Members and Directors, each belonging to the Australian Internet Community.

"Australian Internet Community" means those users and suppliers of services via the Internet who are based in Australia;

..based in Australia i.e. Resident.

Why would any foreign person be eligible to have a say in an industry that they cannot partake in?

GAC Principle 9.1.8
all .au registrations require the registrant to be resident in Australia.

9.4 Qualification for Supply Class Membership
  • Only One Legal Person [employee] of a Registry Operator, Registrar, Reseller, or an association of membership qualifies for a supply class membership.
9.5 Qualification for Demand Class Membership
  • Any Legal Person that does not qualify for Supply Class membership may apply to be a Demand Class Member.

A legal person includes Natural Persons – Belonging to, the Australian Internet Community, resident of Australia.
Foreign persons [citizens of another country] do not have the capacity to qualify for membership because they are unable to register a domain name in Australia, and to register a domain name in Australia requires them to be Australian residents.

3.2 Activities
b. establishing mechanisms to ensure it is responsive and accountable to the supply and demand sides of the Australian Internet Community;
g. ensuring its operations produce timely outputs which are relevant to the needs of the Australian Internet Community.

3.2 (b) & (g) established that both supply and demand sides are duely represented through Membership catagories for the purpose of establishing mechanisms to ensure the Board is “responsive and accountable” to the Australian Internet Community and those membership catagories are represented by Directors elected to those Membership catagories for the purpose of ensuring auDA’s operations “produce timely outputs’ relevant to the needs of the Australian Internet Community.

Both supply and demand are categorized by the definition “Australian Internet Community” for the benefit of all Australians, using and or supplying services within the framework of the .au DNS.

if the Board disagrees with the Constitution, why did we elect them?

Nothing prohibits international applicant from being a member, even if local presence is required (again thats not in it) it could be argued that the registry and registrars are local and employees are subsidiaries (or to that effect).

I retract this Comment - After re-reading the Constitution I've changed my view, the entire constitution should read as a whole document, not in isolation to support a bias. I hope the Board can do the same.

auDA under current management Cameron Boardman and a Board which most members never voted for Board is the worst managed "not for profit" I have ever seen and witnessed in my life.

They have totally ruined any chance of this "Not Fit For Purpose" meeting the Government's 29 recommendations.

They all need to be sacked if people really want to save auDA and meet the Government report requirements.

How much did Cameron Boardman and the Board waste on the Timor Leste .TL namespace? That would have been instant dismissal in most organisations.

Did Boardman plan to run the .TL namespace via the auDA new auHQ?

Does he know Timor Leste is another country and is not Australia?

Show members the financials and expenses involved in that absolute breach of the auDA Constitution and corporate law ( using auDA the Australian Not for profit's funds offshore for another country namespace development, ...paying "Consultants" using auDA Funds to be involved in the .TL Namespace and Timor Leste).

It seems there are no shortage of highly qualified suitable replacements for the role of auDA CEO.

Fresh highly qualified new CEO auDA Management would greatly assist auDA meeting the Governments 29 requirements as would removal of the other responsible Directors who have seemingly signed off on very poor auDA management long enough.

The other members Board, Stakeholders, Government and auDA Members should consider this option now as the Grumpier SGM draws nearer.

This is interesting, surely the Board has vetted his qualifications and previous experience. I guess, to stop any doubt, the Board should limit any further rumor and speculation by vetting the documents at the next board meeting, and note it in the public minutes as true and correct.
