Question about Auda Complaint Process?

Hi All,

I have a question, if you have a brand which wants to put a complaint to Auda if some one has gone and taken all miss spellings of the trademark/ brand domain and re directing them to advertising filled pages, what sections from AUDA policy do you quote when you make a complaint.

You don't have to quote any policy - just tick the appropriate box out of the three options, and then give details.

The problem is the client has filled in the forms already, we have filed the complaint and AUDA has knocked it back, I called them to investigate the issue further and the guy said when doing the complain form we need to site the breach of policy, and reference to the related sections from policy?

James, that seems strange that they have asked you to quote relevant sections. :confused:

The form looks to be very simple - they even given you a choice of three policies to choose to complain about! (And they give you links to them). Yours is obviously the "misspelling" one. It doesn't ask you to nominate sections - just simply tick the box and describe the complaint.

Just a follow up to this - I remembered that Vanessa from auDA had written a blog article about "complaints" and how to make them.

It does say in there that you should quote relevant policy:

If you decide you do want to lodge a complaint about a registered domain name, here are a few other important things to know:

  • Do your homework. For example, use the WHOIS tool to find out information about the domain name, including registrar information and the identity and contact details of the registrant.
  • Refer to the auDA policy you believe the registrant is non-compliant with
  • Explain why and which part/s of that policy you think the registrant has not adhered to

If you can reasonably explain how you believe a registrant is in breach of auDA policy/s then lodge your complaint by submitting the online form at http://www.auda.org.au/form-complaint-domainname.php.

Thanks for the help.

I found that AUDA did not seem that helpful on the phone, more help coming here =)

We did, we also called AUDA.

They were requesting specifics in the complaint hence asking here for a quick answer form the professional.
