Netfleet question.

You make an offer on a domain and the offer becomes legally binding for a period of 30 days. Fair enough.

If that offer is declined prior to the 30 days and is met with a counter offer you do not wish to submit, are you still bound to the initial declined offer?

my logic would say no...if they say "no, thanks" you know you can use your money for something else...but lets see the official response, it will be interesting to know indeed.

As a seller on Netfleet, there is not a function to outright decline or reject an offer. You basically have three options - Accept, Counter or Ignore.

We recommend that everybody at least Counter (perhaps with a firm statement "This is my final offer")

If the seller counters then has a change of heart a few days later & accepts the original offer then yes you would be bound to that offer.

Please let us know if that sounds fair and/or works for you as buyers and sellers. We are always keen to hear suggestions with this sort of stuff

Thanks guys

I think it sounds fair. If the buyer wasn't willing to pay that amount they wouldn't have made the original offer.

If the seller wants to try and get a little more then that too is fair enough, it's all a part of the negotiation process.

Thanks David,

Yeah the system is probably fair, although it is far from ideal from a buyers point of view.

Ideally if you heard nothing for 14 days (as you say the seller has the choice to simply "ignore') the offer should be deemed void through disinterest on the sellers behalf.

If the seller declines an offer then the intial offer should become void instantly so prospective buyers don't have their funds tied up in offers that "may" come to fruition in the eleventh hour.

Thirty days seems a bit excessive.

I have 4 recent offers still "live" according to Netfleet policy. Two of them haven't even contacted me after a fortnight and the other two I had replies almost instantly though I am not prepared to pay what they seek, so ideally from a buyers point of view, it would be nice to know I can at least go shopping for others using these funds.

In my opinion, any formula should be geared towards the buyer buying domains and not impeded by policy or domainers who can't be arsed replying to offers.

Thanks

Maybe we could reduce the 30 days?

What does everybody think? There are lots of buyers and sellers on DNTrade so we're happy to listen to whatever everybody wants.

No system will ever be ideal - we're trying to get something that strikes a balance between buyers and sellers (who naturally will want things differently).

Sound good.

All the buyer really wants is a response in a reasonable time.

If the seller cannot respond within say 14 days.. then they miss the boat.

Whenever i've made an offer on a domain and not had a response within a few days I get frustrated and just want to know what's happening the other end.

If they want to sell the least they can do is let you know where they're at.

Understandably there are circumstances that may take some time, but i'm spending a month in hospital and can get here and post, the least sellers can do is reply within 14 days.

+1 to that John.

Poor business practise shouldn't be rewarded with safeguards.

Ultimately it is the buyer who drives industry, not the seller, so I'm all for lessening the binding period. Any changes that can be made to enthuse the buyer will be beneficial for both buyer and seller in the long run.

good move considering the time to the transfer comes into it , if i am serious about a name i will have purchased within 2 weeks or i will accept an offer if i am the seller within 2 weeks , a new offer can always be made if need be after 2 weeks
