It seems there are a fair few existing trademarks on this name already.

If you aren't one of the trademark holders, how risky is it to bid on this domain? I mean, if you intend to use it in an area not covered by any trademark, is it still a good idea to bid or is it money down the drain?

I am about as far from an expert on these matters as one can be - so take what I say with a grain of salt, but...

I don't think you'd have issue from AUDA perspective owning this domain.

As for if you'd have a legal issue from infringing on someone's trademark I suspect that would largely depend on what you would use the domain for and if it could be construed that you were passing off...

My understanding is that just because someone calls their cafe "Frank" and trademark the name doesn't mean someone can't call their range of stuffed toys "Frank" and trademark the term in relationship to toys...

Of course if the above was the case and you then turned around and started a website selling stuffed toys on Frank.com.au when someone has already trademarked the term in this class you might find yourself in some hot water.

frank is sold but the conversation is still valid.

whenever i have phoned the trademark people the answer is always consistant.

"there is DOVE soap, and DOVE chocolate, whoever owns dove.com.au doesn't matter as long as they stay within their own ballpark."
