Business names in use overseas

Hey dudes,

I realise this isn't a business or legal forum so probably isn't the best place to ask, but I thought I might have a crack incase anyone here has some firsthand experience with starting a business or registering a business name.

I want to register a .com.au domain name and trademark the business name for use in Australia. Is this possible even though the same business name is used in America where they have the .com domain to go with it?

It's a completely different industry/product/service so I'm not worried. I'm more worried that they call themselves an international business. Wouldn't they have to trademark the business name in Australia to have protection?

I am in no way a professional in this field, but I think that you would be in the clear to register the business name and trademark here. If the trademark was being registered in say "widgets" and the company in the US had the trademark in "blubits" then there is no problems for you.

As long as it's a different TM class you should be fine.

we have Dove soap and Dove chocolate.. same mark, different class etc..
