.Com.Au has far more mindshare than any other .AU SLD. A simple survey of the public should confirm this.

Agree, but AUDA isn't going to listen to this, they want some technical/academic reasons as to why .com.au would get preference.

The "common sense" arguments tend to by ignored. So they'll say .id.au owners have just as much rights as .com.au owners and we'll likely end up in auction scenarios in .au ever happens at all.

It's just nothing more than a revenue push... there will be plenty of folks that benefit from rules no matter which way they offer first right to purchase. My worry is that many great domains will be locked up with owners having no intention of using, as I saw the new domains being an opportunity for many folks to secure some decent EMDs

Agree. This kind of release isn't going to increase development. I remember years ago with AUDA's generic auctions very few domains were being developed (of the names I watched) despite them being high quality names. A lot just went to corporates as defensive reges to prevent others using them.

For .au it will be far worse because there will be a low incentive to develop due to confusion issues. It is comparable to a new tld release.

I doubt that it even get off the ground. It's obvious that there's no hierarchical rights so it's the class action if .com.au domain owners are given priority that would be of most concern.

After the AGM and Luke's question about has AUDA received legal advice to which the answer from AUDA seemed to be "no", I have been thinking more about this (see youtube link below @ 1:28 minute mark)

I think if .com.au owners are not guaranteed rights then is more likely to lead to lawsuits, e.g. if you get the scenario of realestate.net.au having equal rights to realestate.com.au and some kind of random chance draw is proposed, gumtree.id.au and gumtree.com.au, news.com.au and news.org.au.

I would say a decent chunk of Australia's biggest companies are going to have this issue. Surely this is going to lead to many lawsuits or potentially class action lawsuits. (it was suggested in the audio that people are already known to be considering actions) If AUDA loses where does that put the organisation given they have maybe $14 million in the bank and they are likely to be up against a whole lot of multi billion dollar companies?

How about all domain owners get an email given the choice to evolve their domain on a first-come-first-served basis.

Then you can ignore the email and keep your status quo

How about auDA goes back a step and auDA contacts every single registrant of an .au domain name and gives them the opportunity to “have a say” about introducing direct registrations with full facts as to costs and implications?

We were both on the auDA 2015 Names Panel, and part of the Minority Report that did not agree with the need for direct registrations. Two years later we are even more convinced of this. It will effectively be a “double tax” on existing registrants – and an unnecessary “cash grab” by some."

  • However, we do realise that there are some who have a different point of view to ourselves. Those that are in favour of direct registration. To them we say this. Our consistent position is that if auDA contacts every single registrant of an .au domain name and gives them the opportunity to “have a say” about introducing direct registrations (with full facts as to costs and implications), then we will accept the majority view. This hasn’t been done to date – and it should be. We must ensure that the decision is truly representational, and not a veiled attempt at pushing an agenda.
  • If a full and proper consultation is not done, we commit to try and overturn the existing direct registration decision at Board level.
  • If we are unsuccessful, then we’ll do our best to ensure that existing com.au registrants are protected and afforded priority rights. Why com.au registrants as opposed to any other .au extension? Because com.au holds approximately 90% of all domains in Australia."
