We will check with auDA if that is indeed the case as I know that there are no system in place that actually checks if the original domain is still registered once a token has been applied for. So it might be that it should but will not actually do anything unless someone makes a complaint.
That sounds greatRegistrars now get notified by identity Digital when a contested domain is released. These domains are then added to the registrant's account and 1 year registration is added to the domain from that date.
So a framework is in place now for registrars to be notified.

but if expires and drops, on the day of the drop the .au is given to the other party - this is when the registrar is notified and it is upto the registrar to notify their clients
